Terms of Service

Welcome to Sunlarus. By creating an account or using our mobile app, website, or related services (the "Service") you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Eligibility and account

You must be at least 18 years old to create an account. You agree to provide accurate information and to keep your sign-in credentials confidential. You are responsible for activity that occurs under your account.

2. The Service

These Terms cover the Sunlarus mobile app and web dashboard, which let you monitor production, consumption, savings, history, and alerts for the solar system at your home (the "Service"). The Service is provided by Sunlarus at no additional charge.

These Terms do not cover the solar equipment installed at your home or any subscription, rental, or other fees you pay for that equipment — those are governed by the separate solar agreement between you and Sunlarus. Nothing in this document modifies, replaces, or adds to that agreement.

To present your savings and history, the Service retrieves telemetry from the equipment at your installation — production, consumption, grid import and export, and battery state where applicable. The Service depends on the equipment being online and reachable, and on third-party systems Sunlarus uses to collect that telemetry.

We do not guarantee that the Service will be uninterrupted, error-free, or available at any specific time. Telemetry values represent the best information available to us; small discrepancies with your utility bill or other readings are normal.

3. Acceptable use

You agree not to:

• Access the Service by any means other than the interfaces we provide.
• Attempt to derive source code, decompile, or reverse-engineer the Service.
• Use the Service to send spam, malware, or otherwise abuse our systems.
• Probe, scan, or test the vulnerability of the Service without our written permission.
• Use the Service in violation of any applicable law.

4. Intellectual property

The Service, including the software, design, trademarks, and content, is owned by Sunlarus Energy LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial purposes while these Terms are in effect.

The solar equipment installed at your home, together with the production and equipment-status data it generates, belongs to Sunlarus under your separate solar agreement. The energy consumption data measured at your home belongs to you; you grant Sunlarus a license to process, store, and aggregate it as needed to operate the Service.

5. Privacy

Our Privacy Policy describes what information we collect and how we use it. By using the Service you agree to that policy.

6. Termination

You may stop using the Service at any time. You can delete your account from the in-app Settings screen, which will remove your account record within 30 days as described in the Privacy Policy. We may suspend or terminate your account if you violate these Terms or use the Service in a way that risks harm to other users or to our systems.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SUNLARUS DOES NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, OR UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

8. Limitation of liability

THE SERVICE IS PROVIDED AT NO ADDITIONAL CHARGE AND IS SEPARATE FROM ANY FEES YOU PAY UNDER YOUR SOLAR AGREEMENT WITH SUNLARUS. THOSE FEES ARE NOT CONSIDERATION FOR THE SERVICE AND ARE NOT RELEVANT TO ANY CLAIM UNDER THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, SUNLARUS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify and hold harmless Sunlarus Energy LLC, its officers, directors, and employees from any claim or demand arising out of your breach of these Terms or your misuse of the Service.

10. Changes

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Material changes will be communicated through the app or by email. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, Florida.
